Agreement to Terms

These Terms & Conditions (“Terms”) govern your access to and use of the Photo Proof mobile application (“App”, “Service”, “we”, “our”, or “us”).

By downloading, installing, or using Photo Proof, you agree to be bound by these Terms. If you do not agree, you must not use the App.

Description of Service

Photo Proof is a mobile application that enables users to:

• Capture photos within the app environment
• Automatically record live GPS location, date, time, and timezone
• Generate a unique verification ID for each image
• Display selected metadata on image templates
• Share or save verified images

Photo Proof is designed to improve authenticity and reduce photo-based misrepresentation.

Internet & GPS Requirement

Photo Proof requires:

• An active internet connection
• GPS/location services enabled

The App will not function properly without these services. This requirement ensures real-time metadata capture and prevents manipulation.

You are responsible for any data charges incurred while using the App.

User Responsibilities

You agree that you will:

• Use the App only for lawful purposes
• Not attempt to manipulate, bypass, or interfere with GPS or internet validation
• Not reverse engineer, copy, modify, or exploit the App
• Not use the App to create misleading, fraudulent, or illegal documentation

You are solely responsible for how you use captured images.

Verification ID System

Each photo captured within the App is assigned a unique verification ID.

The verification system confirms:

• That the photo was captured within the app
• Associated timestamp
• GPS metadata
• Timezone information

The verification ID confirms authenticity of capture data but does not independently verify the factual accuracy of what is depicted in the image.

Intellectual Property

All rights, title, and interest in the App — including software, design, logos, trademarks, and technology — are owned by:

You may not:

• Copy or redistribute the App
• Use branding without permission
• Create derivative works

Users retain ownership of photos they capture, subject to the rights granted in this agreement.

Data & Privacy

Your use of Photo Proof is also governed by our Privacy Policy, which explains how we collect, use, and protect your data.

By using the App, you consent to data practices described in the Privacy Policy.

Prohibited Uses

You may not use Photo Proof to:

• Engage in unlawful activities
• Harass, defame, or violate rights of others
• Submit false evidence in legal proceedings
• Circumvent security protections
• Attempt to alter verification records

Violation may result in suspension or termination of your access.

Account Suspension & Termination

We reserve the right to:

• Suspend or terminate accounts that violate these Terms
• Remove access without prior notice in case of misuse
• Investigate suspicious activity

You may discontinue use of the App at any time.

Disclaimer of Warranties

Photo Proof is provided “AS IS” and “AS AVAILABLE.”

We do not guarantee:

• That the App will be error-free or uninterrupted
• That metadata accuracy is unaffected by external factors (e.g., device hardware limitations, GPS signal issues)
• That verification will be accepted by third parties in legal proceedings

Use of the App is at your own risk.

Limitation of Liability

To the maximum extent permitted by law, Cogniter Technologies shall not be liable for:

• Indirect or consequential damages
• Loss of data
• Business interruption
• Legal disputes arising from image usage
• Reliance on captured photos

Indemnification

You agree to indemnify and hold harmless Cogniter Technologies from any claims, damages, or legal costs arising from:

• Your misuse of the App
• Violation of these Terms
• Unauthorized or illegal use of captured images

Changes to Terms

We may update these Terms periodically. Updates will be reflected by revising the “Last Updated” date.

Continued use of the App after changes constitutes acceptance of updated Terms.
